Terms of Service

1. Acceptance of Terms

By accessing or using Akashic Edge ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Akashic Edge is a political intelligence platform that provides historical election data, prediction market aggregation, arbitrage detection, and analytical tools. We aggregate publicly available data from prediction markets (including Polymarket and Kalshi), government sources, and other public datasets.

4. User Accounts

• You must be at least 18 years old to use this Service
• You are responsible for maintaining the security of your account
• You must provide accurate information when creating an account
• You may not share your account credentials with others
• You are responsible for all activity that occurs under your account

5. Subscription and Billing

Paid subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorize us to charge your payment method for the recurring subscription fees.

• Subscriptions automatically renew unless cancelled before the renewal date
• You may cancel your subscription at any time through your account settings
• Refunds are provided at our discretion and are not guaranteed
• We reserve the right to change pricing with 30 days notice

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Scrape, crawl, or use automated systems to extract data without permission
• Resell or redistribute our data or services without authorization
• Use the Service to harass, abuse, or harm others
• Circumvent any access controls or usage limits

7. Intellectual Property

The Service, including its design, features, and original content, is owned by Akashic Edge and protected by intellectual property laws. Historical election data and public market prices are not claimed as proprietary. Our analysis, tools, and presentation of data are proprietary.

8. API Usage (Oracle Tier)

API access is provided to Oracle tier subscribers subject to rate limits and fair use policies. API access may not be used to create competing services or to resell data. We reserve the right to revoke API access for violations.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AKASHIC EDGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE OR ANY TRADING DECISIONS MADE BASED ON INFORMATION FROM THE SERVICE.

10. Indemnification

You agree to indemnify and hold harmless Akashic Edge from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Service at any time. We are not liable for any modification, suspension, or discontinuance of the Service.

12. Third-Party Services

The Service integrates with third-party platforms including Polymarket and Kalshi. We are not responsible for the availability, accuracy, or terms of these third-party services. Your use of prediction markets is subject to their respective terms and applicable laws in your jurisdiction.

13. Termination

We may terminate or suspend your account at any time for violations of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, United States, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Sangamon County, Illinois.

16. Dispute Resolution and Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules.

• Arbitration shall take place in Springfield, Illinois or remotely via video conference
• The arbitrator's decision shall be final and binding
• Each party shall bear its own costs unless the arbitrator determines otherwise
• You may opt out of arbitration by notifying us in writing within 30 days of creating an account

17. Class Action Waiver

YOU AND AKASHIC EDGE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

18. Third-Party Data Sources

We aggregate data from various third-party sources including:

• Election Data: MIT Election Data + Science Lab, Daily Kos Elections, state election offices
• Demographics: U.S. Census Bureau American Community Survey
• Religion Data: Association of Religion Data Archives (ARDA)
• Prediction Markets: Polymarket (subject to their terms of service)
• Polling: Various pollsters as attributed

Third-party data is provided "as is" and subject to the terms and accuracy guarantees (or lack thereof) of the original sources. We do not guarantee the accuracy, completeness, or timeliness of third-party data.
